Even if your first marriage is void, you CANNOT simply remarry. You must first go to court and get a judicial declaration of nullity. If you skip this step and marry again, your second marriage is also void and you can be criminally charged with bigamy.

Key point

Art. 40 trap: a void first marriage does NOT automatically free you to remarry — you need a court order declaring it null.
