Title IV — Property Relations Between Husband and Wife

Article 74

EO 209 · Family Code of the PhilippinesKey provision

ELI5— what this means for you

Before getting married, couples may choose their property regime through a marriage settlement (prenuptial agreement). The three choices are: (1) Absolute Community of Property (everything is shared), (2) Conjugal Partnership of Gains (each keeps what they owned before marriage, but profits are shared), or (3) Complete Separation of Property (each spouse owns their property independently).

Key point

No prenup = Absolute Community of Property by default. This is the most important default in Philippine family property law.
