Begun and held in Metro Manila, on Monday, the twenty-eighth day of July, two thousand eight.

REPUBLIC ACT No. 9647 June 30, 2009

AN ACT DESIGNATING THE PHILIPPINE NORMAL UNIVERSITY AS THE COUNTRY'S NATIONAL CENTER FOR TEACHER EDUCATION, APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1

Section 1.

Short Title.

- This Act shall be known as the "Philippine Normal University Modernization Act of 2009".

Declaration of Policy.

- It is hereby declared the policy of the State to give priority to the continuing professional training and development of all Filipino teachers and optimize potentials of the country's teaching force to increase access to, promote equity in, and improve the quality of basic and higher education. The State shall likewise give priority to studies education with emphasis on innovations and alternative systems and their utilization and application to teacher training and development.

Section 3 — National Center for Teacher Education.

Section 3.

National Center for Teacher Education.

- This Act designates the Philippine Normal University (PNU) as the National Center for Teacher Education. As such, the PNU, in addition to the powers and functions provided for in its charter, shall perform the following:

(a) Provide technical support to the Department of Education (DepEd) and the Commission on Higher Education (CHED) in their programs and projects that chart policies and recommendations on teacher training, teacher education, continuing professional education of teachers and academic supervisors, and teacher education curricula;

(b) Build and develop a database of education policies to serve as a resource to the country's policymakers;

(c) Conduct researches, case studies, and other appropriate methodologies to enhance curriculum and training designs for teacher training, teacher education, and continuing professional education of teachers and academic supervisors; and

(d) As may be directed by Congress, provide assistance to legislators in the design and analysis of legislative proposals concerning teacher training, teacher education, continuing professional education of teachers and academic supervisors, teacher education curricula, and other issues affecting teacher education.

Section 4 — Teacher Education Standards Development.

Teacher Education Standards Development.

- As the National Center for Teacher Education, the PNU shall make an annual presentation to the DepEd, CHED, the House and Senate Committees on Education, and other education institutions on its proposed standards for teacher training, teacher education, continuing professional education of teachers and academic supervisors, and teacher education curricula. Such presentation shall be made available to the general public especially to teachers and academic supervisors, The presentation shall include but shall not be limited to the following:

(a) Necessary competencies of teachers and academic supervisors in their various fields of specialization;

(b) Innovative strategies and alternative modalities of teaching and learning; and

(c) Information and communication technology breakthroughs to assist the process of teaching and learning.

Education Policy Research and Development.

- As the National Center for Teacher Education, the PNU shall establish an Education Policy Research and Development Office which shall:

(a) Establish and maintain a database of education policies and significant issues facing the country's education system as well as the education systems of other countries especially in the Asia Pacific region;

(b) Create and test different models of teacher education, address key factors in successful teacher education programs and determine which model would best achieve the country's education goals;

(c) Provide a systematic dissemination of research output on teacher education to make them readily available to end users such as teachers, and academic supervisors;

(d) Share research expertise and competence in education research with other Teacher Education Institutions throughout the country,

Provided

, That the research funding of other state universities and colleges shall in no way be affected by the provisions of this Act;

(e) Advise the country's policy-makers and decision-makers in planning, implementing and evaluating reforms in teacher education including the licensing of professional teachers;

(f) Assist in the assessment of government programs on education. As such, PNU may be required by any government agency to comment and/or make recommendations regarding the different policies and programs on education; and

(g) Conduct periodic studies in aid of crafting responsive policies and programs on education.

Section 6 — Philippine Normal University Modernization Program.

Philippine Normal University Modernization Program.

-The PNU shall prepare a modernization plan to fulfill its mandate as the National Center for Teacher Education, and to upgrade its capability to provide pre-service and in-service formation for our country's teachers.

The modernization plan shall enhance curricular programs to make them relevant and responsive to the needs of society and address the educational needs of communities. The plan shall also include a program for staff development as well as for the upgrading of services, facilities and equipment in the University.

The proposed modernization plan shall be submitted to the University's Board of Regents for their approval.

Tax Exemptions.

- The provisions of any general or special law to the contrary notwithstanding:

(a) All revenues and assets of the PNU used actually, directly and exclusively for educational purposes or in support thereof shall be exempt from all taxes and duties;

(b) Gifts and donations of real and personal properties of all kinds shall be exempt from the donor's tax and the same shall be considered as allowable deductions from the gross income of the donor, in accordance with the provisions of the National Internal Revenue Code of 1997, as amended:

, That the allowable deductions shall be equivalent to one hundred fifty percent (150%) of the value of such donation. Valuation of assistance other than money shall be based on the acquisition cost of the property. Such valuation shall take into consideration the depreciated value of property in case said property has been used;

(c) Importation of economic, technical, vocational, scientific, philosophical, historical and cultural books, supplies and materials duly certified by the Board, including scientific and educational computer and software equipment, shall be exempt from customs duties;

(d) The University shall only pay zero percent (0%) Value Added Tax for all transactions subject to this tax; and

(e) All academic monetary awards shall be exempt from taxes.

- The amount of Two Hundred Fifty Million Pesos (Php250,000,000) necessary to carry out the provisions of this Act is hereby appropriated entirely for capital outlay in addition to the current year's appropriations for the PNU.

For the succeeding five (5) years, the amount of One Hundred Million Pesos (P100,000,000) shall be appropriated per year in addition to the annual appropriations for capital outlay of the PNU.

Thereafter, the amount necessary to sustain the program shall be included in the annual appropriations of the PNU.

Section 9 — Separability Clause.

- If any part, section or provision of this Act is held invalid or unconstitutional, other provisions not affected thereby shall remain in full force and effect.

- All laws, decrees, orders, rules and regulations or other issuances inconsistent with the provisions of this Act are hereby repealed, amended or modified accordingly.

- This Act shall take effect fifteen (15) days after its publication in at least two (2) newspapers of general circulation.

Ang PNU: Pambansang Sentro ng Pagsasanay ng mga Guro sa Pilipinas

May isa kang guro na nagbago ng iyong buhay. Ngayon, may batas na nagtitiyak na patuloy na magbabago ang kalidad ng mga gurong Pilipino.

Iyon ang layunin ng Republic Act No. 9647, o ang Philippine Normal University Modernization Act of 2009, na nilagdaan noong Hunyo 30, 2009.

Sa madaling salita: Ang batas na ito ay ginagawang opisyal na "center of excellence" ang Philippine Normal University (PNU) para sa lahat ng bagay na may kaugnayan sa pagiging guro sa Pilipinas. Mula sa pagsasanay ng mga bagong guro hanggang sa patuloy na pag-aaral ng mga nagtuturo na — ang PNU ang pangunahing institusyon.


Tunay na Sitwasyon: Si Ate Cynthia sa Cagayan de Oro

Si Ate Cynthia, isang 32-taong-gulang na high school math teacher sa Cagayan de Oro, ay napansin ng kanyang principal na ang kanyang pamamaraan sa pagtuturo ay medyo lumang-luma na.

"Teacher, pwede kang sumali sa in-service training na inorganisa ng DepEd at PNU," sabi ng principal. "Bagong strategies para sa STEM education."

Nag-attend si Ate Cynthia. Natutunan niya ang mga bagong paraan ng pagtuturo ng Algebra na mas interaktibo. Bumalik siyang mas sigurado sa klase.

Ang ganitong uri ng in-service training — nakabatay sa research at standards na itinakda ng PNU — ay isa sa mga direktang resulta ng RA 9647.


Ano Talaga ang Ginagawa ng PNU sa Ilalim ng Batas?

Bilang National Center for Teacher Education (Sec. 3)

1. Technical support sa DepEd at CHED Ang PNU ay tumutulong sa DepEd at CHED sa pagbuo ng mga polisiya tungkol sa teacher training, curricula, at continuing professional education ng mga guro at academic supervisors.

2. Database ng education policies Nagtatayo ang PNU ng resource center ng mga patakaran sa edukasyon para sa mga policy makers ng bansa.

3. Research at case studies Nagsasagawa ang PNU ng pananaliksik para pagbutihin ang mga curriculum design at training programs para sa mga guro.

4. Legislative assistance Ayon sa Section 3(d), maaaring hilingin ng Kongreso sa PNU na tulungan silang suriin at idisenyong mga panukalang batas tungkol sa teacher education.


Education Policy Research at Standards

Annual Presentation (Sec. 4)

Bawat taon, gagawa ang PNU ng presentasyon sa DepEd, CHED, at mga komite ng Kongreso sa edukasyon tungkol sa:

  • Mga kakailanganin at kaalamang dapat taglayin ng mga guro sa iba't ibang larangan
  • Makabagong pamamaraan ng pagtuturo at pagkatuto
  • Mga breakthrough sa teknolohiya na makakatulong sa pagtuturo

Ito ay gagawing pampubliko — lalo na para sa mga guro at academic supervisors.

Education Policy Research and Development Office (Sec. 5)

Nagtayo ang PNU ng isang espesyal na tanggapan na:

  • Nagtatago at nagpapanatili ng database ng mga patakaran sa edukasyon
  • Lumilikha at sumusubok ng iba't ibang modelo ng teacher education
  • Nagbibigay ng advice sa mga policy makers
  • Nagtutulong sa pagtatasa ng mga programa ng gobyerno sa edukasyon

Pondo at Modernisasyon (Sec. 8)

Hindi lang title ang ibinigay ng batas sa PNU. May pondo rin:

  • ₱250,000,000 agad para sa capital outlay karagdag sa kasalukuyang badyet
  • ₱100,000,000 bawat taon sa susunod na 5 taon para sa capital outlay
  • Pagkatapos, ang kinakailangang halaga ay isasama sa annual appropriations

Ito ang pondo para sa modernisasyon ng mga pasilidad, kagamitan, at programa ng PNU.


Tax Exemptions ng PNU (Sec. 7)

Bilang isang state university na may espesyal na mandato:

  • Lahat ng kita at assets na ginagamit para sa edukasyon ay exempt sa buwis
  • Ang mga donasyon sa PNU ay exempt sa donor's tax at maaaring i-deduct sa income tax ng donor — at ang deduction ay 150% ng halaga ng donasyon
  • Importasyon ng mga libro at educational computer/software equipment: exempt sa customs duties
  • 0% VAT para sa lahat ng transaksyon ng PNU

Ano ang Hindi Alam ng Karamihan

Maling paniniwala: "Ang PNU ay isang ordinaryong state university lang na para sa mga gustong maging guro."

Katotohanan: Sa ilalim ng RA 9647, ang PNU ay may natatanging mandato na higit pa sa pagtuturo ng mga estudyante. Ito ay ang pambansang sentro ng pananaliksik, patakaran, at pamantayan para sa lahat ng teacher education sa Pilipinas — kabilang ang pagtulong sa ibang Teacher Education Institutions (TEIs) sa buong bansa.

Maling paniniwala: "Ang PNU ay para lang sa mga mag-aaral na nasa Manila."

Katotohanan: Ang PNU ay may mga campus sa iba't ibang bahagi ng bansa. Bilang National Center for Teacher Education, ang epekto ng PNU ay nararamdaman sa buong Pilipinas sa pamamagitan ng research outputs, training modules, at policy recommendations na ginagamit ng DepEd at CHED.

Maling paniniwala: "Ang batas ay para lang sa PNU administration — wala itong epekto sa ordinaryong guro."

Katotohanan: Ang teacher training programs na dumadaan sa DepEd at nagmumula sa PNU research ay direktang nakakaapekto sa mga guro sa buong bansa — kabilang na ang in-service training, continuing professional education, at mga bagong teaching strategies.


Ano ang Gagawin Mo Bilang Isang Guro o Estudyante ng Education?

Hakbang 1: Kung ikaw ay isang teacher education student, alamin ang mga programs at scholarships na mayroon ang PNU. Bilang National Center for Teacher Education, may espesyal silang mandate para sa fellows at scholars.

Hakbang 2: Kung ikaw ay isang nagtuturo nang guro, hanapin ang mga in-service training programs na nakabase sa PNU research sa pamamagitan ng iyong DepEd Division Office.

Hakbang 3: Kung ikaw ay isang administrator ng isang Teacher Education Institution (TEI), alamin kung paano makiisa sa PNU's research sharing programs para mapabuti ang iyong curriculum.
