AN ACT ESTABLISHING a SENIOR CITIZENS CENTER IN ALL CITIES AND MUNICIPALITIES OF THE PHILIPPINES, AND APPROPRIATING FUNDS THEREFOR

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:

Section 1

Section 1.

Title.

- This Act shall be known as the "Senior Citizens Center Act of the Philippines."

- It is the declared policy of the State to provide adequate social services and an improved quality of life for all. for this purpose, the State shall adopt an integrated and comprehensive approach towards health development giving priority to elderly among others.

a. "Senior citizens," as used in this Act, shall refer to any person who is at least sixty (60) years of age.

b. "Center," as used in this Act, refers to the place established by this Act with recreational, educational, health and social programs and facilities designed for the full enjoyment and benefit of the senior citizens in the city or municipality.

- There is hereby established a senior citizens center, hereinafter referred to as the Center, in every city and municipality of the Philippines, under the direct supervision of the Department of Social Welfare and Development, hereinafter referred to as the Department, in collaboration with the local government unit concerned.

- the centers are extensions of the fourteen (14) regional offices of the Department. They shall carry out the following functions:

Identify the needs, trainings, and opportunities of senior citizens in the cities and municipalities;

Initiate, develop and implement productive activities and work schemes for senior citizens in order to provide income or otherwise supplement their earnings in the local community;

Promote and maintain linkages with provincial government units and other instrumentalities of government and the city and municipal councils for the elderly and the Federation of Senior Citizens Association of the Philippines and other non-government organizations for the delivery of health care services, facilities, professional advice services, volunteer training and community self-help projects; and

To exercise such other functions which are necessary to carry out the purpose for which the centers are established.

- the Secretary of the Department of Social Welfare and Development (DSWD) may designate social workers from the Department as the workers of the centers:

Provided, however,

That the Secretary may appoint other personnel who possess the necessary professional qualifications to work efficiently with the elderly of the community.

The Secretary may also call upon private volunteers *who are responsible members of the community to provide medical, educational and other services and facilities for the senior citizens.

- a senior citizen who suffers from a contagious disease, or who is mentally unfit or unsound and whose actuations are inimical to other senior citizens as determined by the DSWD on the basis of an appropriate certification by a qualified government or private volunteer physician, may be denied the benefits provided in the Center. However, the Center shall refer the senior citizen concerned to the appropriate government agency for the needed medical care or confinement.

- the Center shall be exempted from the payment of customs duties, taxes and tariff*s on the importation of equipment and supplies used actually, directly, and exclusively by the Center pursuant to this Act, including those donated to the Center.

- Within sixty (60) days from the approval of this Act, the DSWD, in coordination with other government agencies concerned, shall issue the rules and regulations to effectively implement the provisions of this Act. Any violation of this section shall render the concerned official(s) liable under Republic Act No. 6713, otherwise known as the "Code of Conduct and Ethical Standards for Public Officials and Employees" and other existing administrative and/or criminal laws .

- the DSWD, in coordination with the Department of Health and other government agencies and local government units, shall assist in the effective implementation of this Act and provide the necessary support services.

- the amount necessary to carry out the provisions of this Act shall be included in the General Appropriations Act of the year following its enactment into law and every year thereafter.

The sum necessary for the continuous operation of the centers shall be subsidized in part by the DSWD and in part by the local government units concerned.

- All laws, decrees, executive orders, and rules and regulations, which are not consistent with this Act, are hereby modified, amended or repealed accordingly.

Sa ilalim ng RA 7876, ang lungsod ng Iloilo ay may obligasyon na magkaroon ng Senior Citizens Center. Kung pumunta si Lola Nena doon, matatanggap niya ang recreational programs para sa mental health, access sa health check-ups mula sa DSWD-designated social workers at volunteer medical professionals, at makaka-link siya sa mga livelihood programs para may karagdagang kita.

Hindi kailangan ng referral. Hindi kailangan ng maraming papeles. Ang kondisyon lang ay: 60 taong gulang pataas, at hindi siya may contagious disease o mentally unfit (Section 7).


Ano ang Sinasabi ng Batas

Inaprubahan ni Pres. Fidel V. Ramos ang RA 7876 noong February 14, 1995 — angkop na petsa para sa batas na nagmamahal sa ating matatanda. Ang buong titulo: An Act Establishing a Senior Citizens Center in All Cities and Municipalities of the Philippines.

Sino ang "Senior Citizen" (Section 3)

Ayon sa batas, ang senior citizen ay ang sinumang taong 60 taong gulang pataas. Simple at malinaw.

Pagtatayo ng Centers (Section 4)

  • Mandatory sa bawat lungsod at municipality ng Pilipinas
  • Sa ilalim ng direktang supervision ng Department of Social Welfare and Development (DSWD)

  • Mag-maintain ng linkages sa provincial at lokal na pamahalaan, DOH, at iba pang agencies
  • Mag-coordinate sa Federation of Senior Citizens Association of the Philippines at NGOs para sa health care at professional advice

Center Workers (Section 6)

  • Ang DSWD Secretary ay maaaring mag-designate ng social workers mula sa DSWD bilang center workers
  • Maaari ring mag-appoint ng ibang professionally-qualified personnel
  • Ang Secretary ay maaaring humingi ng private volunteer doctors, nurses, at educators para sa mga serbisyo

Tax Exemption (Section 8)

Ang Senior Citizens Centers ay exempt sa customs duties, taxes, at tariffs sa importasyon ng equipment at supplies na ginagamit ng Center — kasama ang mga donated items.


Ano ang Kahulugan Nito Para sa Iyo

Kung senior citizen ka: May karapatang pumunta ka sa lokal na Senior Citizens Center ng iyong lungsod o munisipalidad. Libre ito. Doon, maaari kang makakuha ng health services, makiisa sa livelihood programs, at makipag-socialize.

Kung may matatandang kamag-anak ka: Ang iyong nanay, tatay, lolo, o lola ay may karapatang mag-access sa mga serbisyo ng center. Kung hindi alam ng iyong family kung saan ang center, makipag-ugnayan sa DSWD regional office o sa lokal na City/Municipal Social Welfare and Development Office (CSWDO/MSWDO).

Kung OFW ka na nag-aalala sa iyong matatandang magulang: Ang mga Senior Citizens Centers ay pwedeng maging ang social support system ng iyong magulang habang nandoon ka abroad — may mga activities na nagpapanatiling aktibo at may komunidad ang iyong pamilya.


Ano ang Karaniwang Mali ang Alam ng mga Tao

Mali: "Ang Senior Citizens Center ay parang retirement home — doon pinipigilan ang matanda." Tama: Ang Senior Citizens Center ay hindi nursing home o assisted living facility. Ito ay isang daytime community center — pumupunta ang senior citizen, nag-aaktibidad, tapos umuuwi. Hindi sila naninirahan doon. Ang batas ay nagtayo ng mga ito para sa social integration at active aging, hindi para isegregasyon ang matatanda.

Mali: "Ang mga serbisyo ay bayad." Tama: Ang mga basic services ng Senior Citizens Center ay libre para sa mga kwalipikadong senior citizens. Ang pondo ay galing sa DSWD at sa LGU concerned (Section 11).

Mali: "Ang batas ay nagtatakda na dapat palagi na inaalagaan ang matatanda sa center." Tama: Ang center ay hindi mandatory para sa mga senior citizens — ito ay isang karapatang ma-avail, hindi obligasyon. Ang mga senior citizens na may malubhang sakit o contagious disease ay maaaring hindi ma-admit sa center para sa kaligtasan ng lahat — sila ay ire-refer sa appropriate government medical facilities (Section 7).


Para sa OFWs at Kanilang Pamilya

Kung ikaw ay OFW na nag-aalala sa iyong mga magulang sa Pilipinas:

Hanapin ang Senior Citizens Center. Makipag-ugnayan sa iyong lokal na City/Municipal Social Welfare and Development Office (CSWDO/MSWDO) para malaman ang location ng Senior Citizens Center sa lugar ng iyong pamilya.

I-enroll ang iyong magulang. Kausapin ang CSWDO tungkol sa kung paano ma-i-register ang iyong nanay o tatay para ma-access ang services ng center.

Ang center ay nagbibigay ng community. Para sa mga senior citizens na nag-iisa dahil ang mga anak ay nandoon sa ibang bansa, ang center ay nagbibigay ng companionship, activities, at social support network.

OFW children may contact the DSWD. Kung ikaw ay OFW at nag-aalala sa welfare ng iyong matatandang magulang, maaari kang direktang makipag-ugnayan sa DSWD regional office na may jurisdiction sa lugar ng iyong magulang. DSWD hotline: 851-8888 o dswd.gov.ph.


Ano ang Dapat Mong Gawin para Ma-access ang Senior Citizens Center

  1. Hanapin ang pinakamalapit na center. Makipag-ugnayan sa iyong City/Municipal Social Welfare and Development Office (CSWDO/MSWDO) — karaniwang nasa city/municipal hall ito. Itanong kung saan ang Senior Citizens Center at ano ang mga available na programs.

  2. Mag-register bilang senior citizen. Para mas madaling ma-access ang mga serbisyo, siguraduhing registered ka sa lokal na OSCA (Office for Senior Citizens Affairs). Ang OSCA ang nag-iissue ng Senior Citizens ID na nagbibigay ng 20% discount sa maraming establishments.

  3. Dalhin ang iyong senior citizen ID. Kapag pumunta ka sa center, magdala ng iyong government ID at Senior Citizens ID (kung meron).

  4. I-report kung walang center sa inyong lugar. Ayon sa batas, mandatory ang senior citizens center sa bawat lungsod at munisipalidad. Kung wala sa inyong lugar, maaari itong ireklamo sa DSWD regional office o sa inyong lokal na sanggunian.

T: Maaari bang mag-avail ng Senior Citizens Center ang isang 58-taong-gulang? S: Hindi, ayon sa Section 3 ng RA 7876. Ang "senior citizen" ay ang sinumang tao na 60 taong gulang pataas. T: Ang DSWD ba ay nagbibigay ng financial assistance para sa mga senior citizens sa pamamagitan ng centers? S: Ang Senior Citizens Centers ay may livelihood programs para tulungan ang mga senior citizens na magkaroon ng karagdagang kita — ngunit hindi ito direktang cash assistance. Para sa Social Pension (monthly stipend para sa indigent senior citizens), ito ay isang hiwalay na programa ng DSWD na maaaring ma-access sa pamamagitan ng CSWDO o DSWD regional office.
